Introduction
Welcome to NexSchedule ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the NexSchedule mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.
By accessing or using NexSchedule, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access or use the Service.
Acceptance of Terms
By creating an account, downloading, installing, or using the NexSchedule app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
You must be at least 13 years old to use NexSchedule. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.
Description of Service
NexSchedule is a business management platform that provides tools for scheduling appointments, managing clients, generating invoices, tracking time, and managing business operations. The Service is available through our mobile application and may include web-based features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.
User Accounts
1. Account Creation
To use NexSchedule, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Account Security
You agree to:
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
- Be responsible for all activities under your account
3. Account Termination
You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.
Subscription and Payment Terms
1. Free Plan
NexSchedule offers a free plan with limited features. The free plan includes restrictions on the number of jobs, customers, and invoice customization options as described in the app.
2. Pro Subscription
Pro subscriptions provide unlimited access to all features and are available on a monthly or annual basis:
- Monthly Plan: $9.99 per month for unlimited access
- Annual Plan: $99.99 per year for unlimited access
Subscription fees are charged in advance and are non-refundable except as required by law or as otherwise stated in these Terms.
3. Payment Processing
For iOS users, subscriptions are processed through Apple's App Store and are subject to Apple's payment terms and conditions. Payment is charged to the payment method associated with your Apple ID.
4. Subscription Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device settings or App Store subscription management.
5. Price Changes
We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will notify you of any price changes in advance.
6. Refunds
For iOS subscriptions, refunds must be requested through Apple's refund process at reportaproblem.apple.com or by contacting Apple Support. We do not provide direct refunds for App Store purchases.
User Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Violate or infringe upon the rights of others, including intellectual property rights
- Upload, transmit, or distribute any harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, redistribute, or sublicense access to the Service
- Use the Service to send spam, phishing, or other malicious communications
- Impersonate any person or entity or misrepresent your affiliation with any entity
We reserve the right to investigate and take appropriate legal action against anyone who violates these Terms, including removing offending content and terminating accounts.
Intellectual Property
1. Our Rights
The Service, including all content, features, functionality, and software, is owned by NexSchedule and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.
2. Your Content
You retain ownership of any content you upload, create, or store using the Service ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing and improving the Service.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business use, subject to these Terms.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXSCHEDULE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service.
Termination
You may terminate your account at any time by deleting it through the app settings. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, for any violation of these Terms or for any other reason we deem necessary.
Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though some information may be retained as required by law or for legitimate business purposes. You are responsible for exporting your data before terminating your account.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NexSchedule operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of that jurisdiction.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NexSchedule regarding the use of the Service and supersede all prior agreements and understandings.
